Center for Advocacy and Human Rights (CADO) & nbsp; welcomes & nbsp; the decisions of the National Council for Combating Discrimination (CNCD) & nbsp; sanctioning the Bogdan Petriceicu Hașdeu-Iași School , Iași County School Inspectorate, “Mihail Sadoveanu” Fălticeni Secondary School, Suceava County and Suceava County School Inspectorate for the segregation of Roma children.
In April 2016, the Center for Advocacy and Human Rights (CADO) through Ms. Mihaela Roxana Prisăcariu filed two complaints with the National Council for Combating Discrimination (CNCD) against:
(a) Bogdan Petriceicu Hașdeu Iași School and Iasi County School Inspectorate for the segregation of Roma children in the C building of the school and the quality of the educational act in this school. The specific reasons for filing the complaint were that in this school students study in 7 buildings, but most Roma students were assigned to body C, reaching according to data provided by the school to over 50% of the total number of students in the school. that body. A group of Roma parents complained about the quality of the educational act in body C, where most children even after completing the fourth grade can not read and write correctly and the fact that most teachers are substitutes or retired. For this reason, parents tried to enroll / transfer children to another school within the same school but were refused. & nbsp;
(b) “Mihail Sadoveanu” Fălticeni Secondary School, Suceava County and the Suceava County School Inspectorate for the segregation of Roma children into classes. & nbsp; In monitoring the school segregation of Roma children in the counties of Botoșani, Iași, Neamț, Suceava and Vaslui, CADO identified that within the Mihail Savoveanu School in the school year 2014-2015, although Roma students represented only 10% of all students , all were merged into separate classes. Specifically, in grades I, IV, VI and VII, Roma students represented between 39% -56% of the total number of students in separate classes, while in the other parallel classes there were no Roma students.
The investigation of the two cases of segregation was carried out with the help of local non-governmental organizations, & nbsp; Asociația Pro Roma din Iași & nbsp; and & nbsp; Asociatia Consultantilor de Desarrollo Comunitaria din Suceava , who participated in a watchdog capacity development program in monitoring the segregation in education of Roma children implemented by CADO and & nbsp; Public Participation Resource Center (CeRe) & nbsp; within the project “ School for all children! ”, Financed by EEA grants 2009 – 2014, within the NGO fund in Romania.
CADO complained to CNCD both the active role of schools in the ethnic separation of Roma students and the passivity of county school inspectorates in fulfilling responsibilities for preventing and combating school segregation in the two school units according to Order no. 1540 of 2007 on the prohibition of school segregation of Roma children and the approval of the Methodology for the prevention and elimination of school segregation of Roma children.
CNCD in both cases & nbsp; decided that class separation and placement & nbsp; in a single building of Roma children when the school has several buildings, respectively the tolerance of these situations by the two county school inspectorates Iași and Suceava is discrimination and violation of the right & nbsp; to dignity according to art 2 par . 1, art 2 & nbsp; para. 4, art. 11 paragraph 1 and art.15 & nbsp; to the O.G. no. 137/2000 on the prevention and sanctioning of all forms of discrimination. & nbsp;
CNCD also fined & nbsp; 3000 lei & nbsp; Bogdan Petriceicu Hașdeu-Iași School, by & nbsp; 5000 lei Iași County School Inspectorate and 2000 lei & nbsp; Suceava County School Inspectorate and asked the county schools and school inspectorates to start the implementation of desegregation plans by 01/10/2017.
At the same time, CADO expresses its disappointment at the approach of the Ministry of National Education and Scientific Research which by address 6137 / 17.10.2016 sent to CNCD stated that the CADO complaint against Bogdan Petriceicu Hasdeu School and Iasi County School Inspectorate regarding Roma children in body C as unfounded, the same ministry that in December 2016 approved Order 6.134 / 21.12.2016 on the prohibition of school segregation in pre-university education units. The contradiction between the two approaches of the ministry shows that, unfortunately, & nbsp; preventing and combating segregation in education is only at the declarative level and not a real interest of the ministry. & nbsp;
